Since I've never met anyone who did not already know this, or disagrees that a certain degree of eminent domain is necessary, I was assuming he was referring to the case that made big news a couple years ago. BTW; how are your efforts to close the road to Cloudcap going? We're implementing a socialists only policy, so I guess you're shit out of luck.
  3. FW, read the constitution. The Fifth Amendment created the power of eminent domain. The case you referred to interpreted the scope of "public use."

  9. India. Also the other mountains I mentioned in East Africa, but more around 14,000 feet. On the Rwenzoris trip we had one guy specifically as a beer porter. yeah but that beer goes down a lot better at 17k.

I have heard that Friend of Tilly Jane are headed up this weekend with permission of the FS to stock the cabin for the weekend, so I expect it to be open at some point once the snow starts flying, but I have no idea what condition the TJ and PR trails are in. I should have more info early next week and perhaps some recent photos.

  13. They make some kind of black goo for water sports - I forget what its called, but it works really well for this purposes. The best fix is getting them resoled and then stop dragging your toe.

  16. A 2nd or 3rd for the DMM Rebels - got a pair last year, b/c the grip fit my small hands better than anything else I had tried an the balance and swing felt great. Love them.

  18. Trip: Shoshone Spire and Bitterroot Climbing - South Face Date: 9/10/2008 Trip Report: Been kinda slow around here for TRs and I finally managed to sort photos from a week-long trip to Montana, so I figured I'd post a link to the blog.
  19. Sux that guy broke his ankle, but I can just imagine that young TV reporter for the Bend station going out to Smith when he gets the report of an accident and then trying to figure out how to dramatize a broken ankle.

I heard from the District Ranger that the Cloud Cap Road will be closed until next summer due the Gnarl Ridge wildfire and continuing erosion control and clean up work ... but she could have been wrong. Can't hurt to call and check. Definitely call to check on the status of area closures if you plan on going up there.
  21. If the ticket is missing info like date, file a motion to dismiss ahead of time. Ask for discovery ahead of time. Contact whomever you can get a hold of (usually the officer) and discuss alternative resolutions (i.e. settlement).
