  6. The reason the evidence would be let in in the second story is because the shooter knew the past of the shootee. In Cat's story the shooter did not know of the history, so it was irrelevant in his decision as to whether to shoot.

One difference in the evidence is that here they knew of the violent past of the dead person, in CBS's facts the persone did not know of the past violent history of the dead person; which is why the evidence came in during this case, not in CBS's case. In both, I say not guilty. A scared person should not become a criminal for trying to protect himself.

  13. I change mine ever few years. Not really based on time, use, looks, or anything else; I change mine when I start thinking about how old my harness is whie I climb. When I am making a crux move and I start thinking about the age of my harness, it is time to change it. I also weigh 200lb, and often get way above my gear and have a long time to think about the age of my harness as I freak out. Otherwise, manufacturers claim to change about every 5 years or so on soft goods such as a harness, but people often use them much, much longer with no problems.
  14. Unless you happen to be that poor sap sitting in prison making unwanted friends, for a crime that you did not commit. to that person, and imperfect criminal justice system is kind of a bad thing.
  15. I am not suggesting vigilantism as the only option, but what I am suggesting is perhaps decriminalizing those who do pursue their own protection and justice. If you find a thief breaking into your car, you should have the choice of calling the cops or trashing the person. If someone is attacking you, you should have the choice of defending yourself or taking the beating and letting a court try to punish him later. I personally believe that the choice should be up to the victim, and the victim should not suddenly become the criminal for protecting his life, property, …
  16. Guys, just know that there are those of us who admire your sacrifice, and make mental notes next to your names that you are stand up guys. I don't believe in karma, but you guys have stars by your names in my book. The right thing is always the right thng.
  17. I once had a client who was alleged to have beaten his brother in law near death when it was discovered that brother in law had molested clients son. People wre offended by the "he deserved it" defense that we tried to mount. Would have been easy for me as a juror to find him not guilty, but society is becoming a place where we are to allow the law to deal with everything rather than protect ourselves and others. What ever happened to the old motto that you mess with someone at your own risk?
  18. Actually I think you do get free beer all weekend from Mgear. As for free beer the rest of the week, it will depend on how you define "free." You are of course welcome to come freeload off our campsite and hook into climbing partners with us, as long as my G/I issues don't interfere with your enjoyment.
  19. Whether the guy is guilty or not depends on the mindset of 12 people. I think cat you are getting an idea of where a seattle jury might land on the issue. I would have let the guy off as a bad decision of a scared person, but that puts me in the minority I believe. Juries do not typically like the self defense argument anymore.

After the event we will move to the 13 mile campground, and you are welcome to bag out with us there too (free) if you like. No, this is not a romantic invitation as I think I am going to turn gay cuz guys are easier to get along with. I have put together a group of volunteers for the weekend event. I made a deal with Mgear to bring down some volunteers and they are paying our transportation and fuel for the trip. Many of the people doing registration and directing at the pull-outs will be with my group. I will be the one with shorts over polypro, gators to keep the snakes out of my sandals, and asking all the cute climbing chics if their name is sherri. I would give you my name, but no one knows me by that anyhow, they just call me "old guy." Offer open to you too Blake, but as a guy we may charge you beer.
  23. Obviously it all should depend on whether the guy actually and reasonably felt that his life was being threatened. As the comments here indicate, most are going to hold him to a pretty hard standard based upon facts learned after the fact. In this guys mind, not knowing anything about the "attacker", he has dogs attacking, and a guy running at him screaming. Easy to see the guy was scared and reacted, and a sad thing happened. The question is whether this guy, who merely went for a walk in the woods, should suddenly find himself in prison? Again, do we punish his intent, punish his actions, or punish the result? Here, I think they punished the result.
  24. Sherri, I will be at the RRR; this will be our first date since our broken engagement, or whatever. Staying the rest of the week after to climb with a small group of great people.
  25. They have been making great strides in the past few years in brain reasearch that I think will create some great evidence against our current criminal law system. I think we all pretty much agree that the way we do it now does not "work" well, the new research could help explain why it does not work and possibly provide better options. Let's change the question a little, should we punish the action or punish the result? If I am driving blind drunk, should I be punished the same whether or not fate has me hurting someone else?
