why? it was a gift. further she's not the one who blew it. if she was the one who had posted the add and he wanted to break it off then she should give it back but he's the one who effed up.

I'm assuming it cost $$$ (as in the 2-month salary rule). The "gift" is a symbol for the committment to marry. Marriage off - gift null and void.

The custom of wearing a ring is that of wearing someone else's ring. It signifies a bond to the owner... historically, it is not a gift.

 

If one wishes to break the bond to the owner, be it man, club, pope, or king, they return the symbol of the bond to the owner.

 

Unless, you want to break it off in his ass... then, you sell the ring and hire a brute squad. boxing_smiley.gif

It's a gift and a symbol of HIS commitment to marry her, and typically that necessitates fidelity. He fucked up. Unless theres more the story she held up her end of the bargain and he didn't. Without some pressing reason she should do as she pleases with it.

 

I'm sorry but he deserves whats happening to him. She screws up, it goes back, the relationship is mutually agreed to be over, it goes back. He's a bastard, she keeps it or does as she pleases.

my understanding is that the custom of the engagement ring was basically as security for the commitment to wed. should the engagement be broken there would be a price for it. thus such things would not be entered into nor broken w/o much consideration. admittedly, in today's society this custom is unnecessarily one sided.

 

regardless, she should take the cad's gift and do something good with it. i recommend using his credit card to buy a matching stone and get a nice pair of ear rings out of the deal.

If it cost the guy so much that it's a serious financial loss to not get it back, it's his own damn fault for spending so much money on a single damn piece of jewlery. If it's an heirloom, that's a different story.

yup! i certainly would've killed my better half if he'd gone into debt for my token of his affection.

 

i would expect that any family heirloom would not be given until the wedding. it would likely be made clear that it would need to be returned in the event of failure. however, i've heard of several cases when that didn't happen. buyer beware i guess.

Engagement ring is a gift in lieu of marriage. Marriage off, ring is returned. There is actual case law substantiating this.

 

However, given the information at hand, methinks he should cut his losses and leave this one alone. There is no honor in fighthing for this one.
