What does this mean: In some sense, the necessity defense allows us to act as individual legislaters, amending a particular criminal projevision or crafting a one time exception to it, subject to court review, when a real legislature would formally do the same under those circumstances. Then they give an example of a prisoner escaping a burning jail and that is an exception. Does this apply to the 9th circuit or are they talking about individual people? I am not experienced reading stuff like this and it is a little teensy bit hard to get the gist. (I'm good at white papers though--go figure.)

  9. I am a bit confused too. I thought opinions were formal "write-ups" (pardon my layman's terms) that were not subject to being ruled on. I thought bills and stuff like that (more law-idiot speak) were the only things that could be overruled.

They vanish when I post, and then when I go back to edit (the post frame is there, just the comment and the ref line are gone) I am told that not all the fields are filled in. The ref line is what holds this back--and shouldn't. This has happened when I send a PM as well. Is there just something wrong with my acct or is there an issue on the site?

  15. I served as an ombudsman later to fight for this very issue. Since the laws around medicaid have changed so drastically (as well as there being different pt laws in WA than in ID) I dont do this anymore. Also, it wears me out b/c I get so fucking mad I just can't function. Just had to get that out--don't know why. Please return to your normal program.

  17. I have a huge problem with this. The war on drugs bullshit is horrifying in its reach. It doesn't do what it's supposed to and innocent people suffer. I've posted here before about how I worked in an old farts' home three years while going to college. I love old people--they rock. They are tough--some of these old bastards and bastardettes were actual homesteaders (this was in Idaho). So here they come to live out the last years of thier lives and some of them were very much in pain. The fucking docs wouldn't give them anything without the biggest battle (a paperwork battle that we CNAs and the RNs had to wage every day). It angered me so bad I still get flushed in the cheek when I think about it. The arrogance of people to believe they can make decisions like this for other people--people who are suffering. NO ONE should suffer unnecesarily in this weathy country. NO ONE should be denied comfort in their dying years. IT IS BULLSHIT!!!

Maybe if this summer we all do that as well as leave a note saying there is nothing of value in the car at E38, we might make a little progress there.   24. In the case of Air Guitar, the bottom can be climbed at 5.9 using faceholds well within reach. Avoiding any facehold definitely makes it harder. Actually, I'll be a dork. The last time I was at Vantage, I speed-toproped Air Guitar, from both feet on ledge (not boulder) to slapping the chains in 1m37s. If anyone wants to play the game of trying to do it faster, it might be fun in the "Uncage the Soul" Colorado lamer sort of way. Dorkiness is good. I have a buddy whom I dork out with and we will do easy climbs and impose lame restrictions on each other. For example, we may say, "Ok, this lap you can't use your left hand" or exclude a key hold. So ghey that it's embarrassing to talk about--but really super fun!
